CAPE TOWN, SOUTH AFRICA – In a decision that has ignited debate over LGBTQ+ rights and the recognition of diverse family structures, the UK Home Office has refused entry clearance to Simone Carmen Johnson, a South African national seeking to join her legally recognized partners in the United Kingdom.
Johnson, part of a polyamorous relationship involving three women—one of whom has transitioned to male—applied for an Unmarried Partner Visa on February 5, 2024. The application was refused on June 26, 2024, citing eligibility relationship requirements under UK immigration rules.
This refusal has raised serious concerns about discrimination and human rights violations:
- The relationship, while unconventional by traditional UK standards, is legally recognized in South Africa.
- The decision potentially violates Article 8 of the European Convention on Human Rights, which protects the right to family life.
- It highlights a clash between UK immigration policy and evolving global norms on family structures and LGBTQ+ rights.
